After we agree on the proposed plan of action and fees, we draft and sign a formal agreement.
According to the Romanian Law on the Legal Profession, fees are generally agreed freely between the lawyer and the client.
An initial consultation with us is usually free of charge.
For further cooperation, just like lawyers from other EU Member States, we offer several types of fees, depending on the nature of the case and the services to be provided, namely:
Setting fees according to a standard scale of fees is unusual, but not ruled out in principle.
In Romania, it is permitted to agree fixed fees. In principle, we can almost always agree flat fees per entire case or per stage of proceedings or court hearing in order to offer clients cost certainty.
Yes, especially if the legal work is also carried out in stages (e.g. in court proceedings).
The coverage of the costs by a legal expenses insurance depends on the insurance conditions and basically on whether the case in which we support you constitutes a matter covered by the insurance. This must be assessed and decided by your legal expenses insurer.
However, we can provide your legal expenses insurance company with all the necessary information (about the nature of the case, the competent courts, etc.) and, if necessary, contact the legal expenses insurance company directly in order to obtain a decision as quickly and favorably as possible.
VAT applies to both private individuals and businesses that are not registered for VAT purposes. For businesses that are registered for VAT purposes, the relevant EU tax rules for cross-border services apply.

In exceptional cases, it may be necessary for the client to have the client agreement notarized if he is unable to sign it personally in our office.

Our client is always kept up to date. The frequency and content of our reports depends on the nature of the case.
In the case of legal proceedings, we confirm the filing of the lawsuit or response, send reports on court hearings and provide information on the conclusion of a stage of the proceedings. For activities where we charge an hourly rate, we send detailed activity reports.
Of course, we will inform the client about the status of his case at any time upon request.
As in all other EU member states, lawyers in Romania are legally obliged to strictly observe confidentiality, discretion and data protection in their work. This is governed by professional regulations, data protection laws and ethical standards.
In both civil and criminal proceedings, there is generally no obligation to appear. The vast majority of legal cases that we handle for our foreign clients do not require the client to appear in person.
There are of course exceptional cases, which are determined according to the nature of the case, more often in criminal proceedings. Sometimes a personal appearance, even if it is not mandatory, can be helpful.
In civil and commercial matters in particular, almost everything can be settled out of court. This is often quicker and cheaper than going to court.
