  • Our services (generically: legal work, including: legal assistance / legal counsel / legal representation) are provided in accordance with Romanian legislation regarding the attorney profession (Legea nr. 51 din 7 iunie 1995, republicată, pentru organizarea și exercitarea profesiei de avocat, publicată în Monitorul Oficial nr. 440 din 24 mai 2018, cu modificările și completările ulterioare; Statut din 2011 al Profesiei de avocat, publicat în  Monitorul Oficial nr. 898 din 19 decembrie 2011, cu modificările și completările ulterioare), and based on a valid legal assistance agreement closed between TALPEȘ – SCPA and the client.

  • We do not perform legal work outside of a valid legal assistance agreement. Any activity carried out before or without signing such an agreement does not constitute legal work and is not binding towards us, and we do not accept any responsibility or liability for such activities. Nevertheless, any activities’ performer by request of the client / potential client even outside of a legal assistance agreement may generate the obligation by the client to pay fees, of these fees have been clearly communicated and accepted in advance by the client / potential client.

  • The legal assistance agreement will expressly describe the object of the contract (the legal work which will be provided) and the applicable fees. Other expenses accruing to the legal shall be undertaken by the client, separately from the payment of the legal fee.

  • The legal assistance agreement represents an enforceable title with respect to the fees owed by the client, representing the attorney’s fee and the accruing expenses.

  • The relations between the parties of the legal assistance agreement can be proven only through the legal assistance agreement and/or as per the terms stipulated by the attorney profession regulation. The legal assistance agreement prevails over the contents of these terms and conditions.

  • Towards any third parties, the proof of the legal assistance agreement is made through a power of attorney. Third parties can be informed with respect to the legal assistance agreement only after the express consent of the contracting parties is obtained.

  • The Client certifies the accuracy and honesty of the information given to the attorney and gives their consent for the work provided by the attorney to be done according to the supplied information.

  • The execution of the obligations undertaken by the attorney (TALPEȘ SCPA) is made by the partner attorneys, by collaborating attorneys, or by attorneys designated as substitutes.

  • The failure to pay the attorney’s fee in the amount and until the deadlines stipulated in the legal assistance agreement, and the failure to pay the expenses made as per the provisions of the legal assistance agreement, give the attorney the right to rightfully terminate the contract, without any other formalities and without any other judicial or extrajudicial procedures.

  • All disputes regarding the conclusion, modification, termination, interpretation and execution of the legal assistance agreement will be governed by the arbitrage or procedure regulations stipulated by the law and the attorney profession regulation.
